The Building Safety Levy (the levy) is a national charge applied to new major residential buildings/developments, unless evidence of statutory exemption is provided, through the Building Control process, that will apply to relevant Building Control applications/initial notices submitted on or after 1st October 2026.

The income raised from the levy will contribute to fixing building safety defects across England. Bury Council is responsible for the administration and collection of the levy within the borough.

Levy rates:

The government has set the levy rates for each local authority area in legislation. The rates have been weighted using average house prices in local authority areas. The levy rates are set per square metre, and the charge is calculated on the floorspace of the development. There are exemptions from the levy for certain residential uses of buildings and a discounted rate for developments that meet the definition of previously developed land (PDL).

The levy rates set by the government for Bury Council:

  • Standard rate (non-previously development land): £24.29 per m2
  • Previously developed land rate: £12.14 per m2

Checklist for developer/agents:

When submitting for building control approval for works which relate to the provision of one or more new dwellings or new PBSA bedspaces, in all cases levy information will need to be provided on submission, to allow the local authority to verify whether a levy charge is payable.
