An Article 4 Direction is a planning tool used by local authorities to restrict certain permitted development rights. It requires property owners to seek planning permission if they wish to make certain changes that would otherwise be allowed without having to apply for planning permission. 

Houses in Multiple Occupation Article 4 Direction

Following concerns about the increasing number of Houses in Multiple Occupation (HMOs), and the need to ensure that proposals provide a good standard of accommodation for their occupants, as well as seeking to avoid unacceptable impacts on neighbours or the character of the area, the Council has decided to introduce an 'Immediate Article 4 Direction’ relating to small HMOs.

What does this mean?

Under permitted development rights granted by national legislation, the change of use from a dwelling (Use Class C3) to a small House in Multiple Occupation (Use Class C4), occupied by up to six unrelated individuals, can normally take place without the need for planning permission.

The Council has introduced an Article 4 Direction that removes the permitted development rights for the material change of use from a dwellinghouse (Use Class C3) to a small House in Multiple Occupation (Use Class C4). 

This means that planning permission is now required to create any new Houses in Multiple Occupation (HMOs) within the Borough. The Article 4 Direction does not apply retrospectively to existing HMOs.

The Direction applies to the entire Borough of Bury and came into effect on 16 July 2026

Although the Article 4 Direction takes effect immediately, the Council is required to carry out public consultation before deciding whether to confirm the Article 4 Direction.

Consultation on the Article 4 Direction is taking place from 16 July 2026 until 27 August 2026.
