This privacy notice is to the supplement the information on the primary Bury Council Privacy notice, to specifically relate to the delivery of the Homes for Ukraine scheme. The code data protection obligations and commitments are set out in the Council's privacy notice.
Why do we need person information?
- This is to enable us to process the necessary safeguarding welfare and accommodation checks required for local authorities to carry out as per government guidance set out in the Homes for Ukraine scheme. Homes for Ukraine guidance for councils (Gov.uk).
- This is to ensure the safety and wellbeing of sponsors, and your guests, to mitigate the risk of harm to any individuals and ensure the suitability of sponsorship.
- As a sponsor we also require this information to process the thank you payments set out by national government for sponsoring a Ukrainian individual or family through the Homes for Ukraine scheme.
- We will only use your information in ways which are permitted by the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018 (DPA).
What types of personal information do we handle?
- Contact details such as names, addresses, e-mail addresses and telephone numbers to process accommodation checks
- Personal demographics including date of birth to process DBS checks
- For guests we will receive Homes for Ukraine visa status from the Home Office.
Information is provided from the Home Office and Department for Levelling Up, Communities and Housing, through the Palantir Foundation system which details the information referenced above submitted as part of the visa application process.
Responses to accommodation and DBS checks are entered onto the password protected Palantir system and password protected Council spreadsheet used to co-ordinate such checks.
Legal basis for processing personal information
- GDPR Article 6 (1) (a) with regards to consent; 6(1)(c) in relation to conducting legal duties on behalf of central government; and 6(1) (e) in relation to official authority in conducting safeguarding checks as per the joint visa application between sponsor and guest through the Homes for Ukraine scheme
- GDPR Article 9(2)(h) in relation to health or social care to support access to appropriate public service support and pathways.
- DPA 2018 Part 3 (35) (2a) with regards to DBA checks
Data retention
We will retain your information in accordance with statutory retention periods, in order to comply with legal and regulatory requirements or, for other operational reasons.
In relation to the Homes for Ukraine scheme this will be for a period of three years, except for data relating to financial records which will be retained for six years.
Rights of individuals
You have the right to:
- request a copy of your information (known as a subject access request);
- request rectification or erasure of your information;
- request a restriction on the processing of your information and, object to processing of your information;
- complain to the Information Commissioner's Office about the way the Council processes your information.
