Public Spaces Protection Orders are designated for the purposes of the Anti-Social Behaviour Act 2014.
Persons failing to comply with a request by a police constable or Authorised Council Officer exercising their power under this Act may be subject to summary prosecution which may lead to a fine being imposed.

Restrictions
The PSPO prohibits the following activities:
- The consumption of alcohol
- The use of amplifiers or speakers
PSPO Extension 2026
On Wednesday 11 March 2026, the extension to the Public Space Protection Order (PSPO) was approved by Cabinet.
The PSPO came into force on 20 April 2023 for a period of 3 years and has been extended for a further three years, from 20 April 2026 to 19 April 2029.
The PSPO helps address behaviours that can negatively affect people’s enjoyment, safety, and wellbeing when using public spaces. By extending the order, the Council aims to continue supporting a safe, welcoming, and enjoyable town centre for residents, visitors, and businesses alike, while working with partner agencies to prevent anti-social behaviour and promote positive use of the area.
Exemptions
This PSPO does not apply to licensed premises or registered clubs or places where the sale of intoxicating liquor has been authorised by a club premises certificate, a temporary permission or premises licence.
The following are not designated public places:
- Premises which hold a premises licence or club premises certificate authorising the sale or supply of alcohol and places within the curtilage of such places
- Premises at any time where a valid temporary event notice is in force, during the period when alcohol is being sold or supplied and for a period of 30 minutes thereafter

Bury MBC Public Spaces Protection Order (Extension) 2026
Bury Metropolitan Borough Council ('the Council') in the exercise of its powers pursuant to Section 59 and Section 60(2) of the Anti-social Behaviour, Crime and Policing Act 2014 ('the Act') and of all other enabling powers, being satisfied that the conditions as set out in Section 59 of the Act have been met hereby makes the following Order:-
The Public Spaces Protection Order 2023 (‘the 2023 Order’) which took effect on 20th April 2023, is extended for a period of 3 years from 20th April 2026 to 19th April 2029.
This Order applies to the public spaces described shown outlined in red on the map annexed to this Order ('the Restricted Area').
The effect of the 2026 Order will be to extend the 2023 Order to 19th April 2029.
This Order shall be cited as the Bury Metropolitan Borough Council Public Spaces Protection Order (Extension) 2026. The Order shall take effect on 20th April 2026 and will be in force for 3 years, subject to any further variation or extension of the Order.
The effect of the Public Spaces Protection Order will be to impose the following restrictions within the ('the Restricted Area'):-
1. Consumption of alcohol whilst in a public space
No person shall at any time continue to drink alcohol or refuse to hand over an open alcohol container when required to do so by an Authorised Officer.
2. Use of amplified sound equipment
No person shall at any time use amplified sound equipment, including but not limited to speakers and microphones.
Exemptions
This Order does not apply to licensed premises or registered clubs or places where the sale of intoxicating liquor has been authorised by a club premises certificate, a temporary permission or premises licence, pursuant to Section 62 of the Act.
The following are not designated public places:
- Premises which hold a premises licence or club premises certificate authorising the sale or supply of alcohol and places within the curtilage of such places.
- Premises at any time where a valid temporary event notice is in force, during the period when alcohol is being sold or supplied and for a period of 30 minutes thereafter
Offences
- A person shall be guilty of an offence pursuant to Section 63 of the Act if he/she does not comply with an instruction given by an authorised person, not to consume alcohol or to surrender alcohol or container for alcohol, within the Restricted Area.
- Any person who, without reasonable excuse, fails to comply with the requirements of Part 1 of this Order commits an offence and shall be liable on summary conviction to a fine not exceeding level 2 on the standard scale.
- Any person who, without reasonable excuse, fails to comply with the requirements of Part 2 of this Order commits an offence and shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale.
- A Fixed Penalty Notice of £100.00 may be issued to offenders, which would discharge any liability to conviction for an offence under Section 63(2) or Section 67(1) of the Act.

NOTICE IS HEREBY GIVEN that the Bury Metropolitan Borough Council (‘the Council’) in exercise of its powers under Section 59 and Section 60 of the Anti-social Behaviour, Crime and Policing Act 2014 (‘the Act’) and of all other enabling powers and being satisfied that the requirements of the Act have been met make the following Order:-
- The Public Spaces Protection Order 2023 (‘the 2023 Order’) which took effect on 20 April 2023, is extended for a period of 3 years from 20 April 2026 to 19 April 2029.

If you wish to question the validity of the 2026 Order that the Council did not have the power to make the Order, or to include particular prohibitions or requirements imposed by the Order, or that a requirement under Chapter 2 of the Act was not complied with, you may within six weeks from 20 April 2026 apply to the High Court pursuant to Section 66 of the Act.
