Bury Council is seeking a public basis protection order to allow for lockable gates to be installed and maintained across the ginnel connecting Sawley Avenue, Whitefield and Malton Avenue, Whitefield.
This has been pursued in response to repeated incidents of crime and anti-social behaviour primarily substance misuse occurring at this location, and serious violent crime.
Residents who occupy properties directly attached to the proposed gated root would be given access, the council and emergency services will also have access.
The council has to be sure that this is the right thing to do so as a local resident, land or property owner, someone who works in the area, and all other interested parties, it’s very important that you give us your views to help us decide whether to go ahead with the scheme or not.
We can restrict access to public rights of way, including alleyways, in order to tackle persistent crime and anti-social behaviour by installing lockable gates at either end of the alleyway.
We have the power to restrict access to a public right of way by installing alley gates for example, under the Anti-Social Behaviour, Crime and Policing Act 2014 acts public spaces protection order provisions.
In doing so, we have to ensure:
- The anti-social behaviour activities it seeks to tackle justify the restrictions being imposed;
- Whether it can restrict access.
- The impact the restriction will have on access between two places
- And weather reasonably convenient alternative routes exist.
When looking at making a public spaces protection order (including an order to restrict access to a public right of way, including alleyways) we are required to consult with the following:
- The local police, including the police and crime commissioner and the community safety partnership.
- Any landowners or occupiers, i.e. any residents including home owners, tenants, landlords and property owners directly affected by the proposal.
Please complete the following survey to give your views about the proposed Public Space Protection Order (PSPO) with regards to 'Alleygating' of the ginnel, that runs between Sawley Avenue, Whitefield, and Malton Avenue, Whitefield.
The proposal is to erect a gate on either end of the ginnel, one at the Malton Avenue entrance, and one at the Sawley Avenue entrance. These Alley gates will restrict access to all members of the public, permanently, with access only being granted to the Local Authority, Emergency Services and any other necessary authority.
