Your guide to the information we keep about you

Our core data protection obligations and commitments are set out in Bury Council's main privacy notice and Children and Young Persons privacy notice.

This privacy notice explains how Bury Council uses and shares information as part of its work to support young people moving into and participating in post-16 education and training.

This privacy notice should be read alongside the Connexions Bury privacy notice, as information shared through these arrangements may form part of the Council's participation tracking and support records.

What is Post-16 Transition Information Sharing?

Bury Council works with Post-16 Education Providers, including colleges, school sixth forms and training providers, to support young people aged 16 to 18 to successfully participate in education or training.

To help us provide appropriate support and meet our statutory responsibilities, we may share and receive limited information about learners with Post-16 Education Providers.

The purpose of this information sharing is to:

  • support young people to remain engaged in education or training
  • identify learners at risk of disengagement or persistent absence
  • enable timely support, intervention and signposting where required
  • support safeguarding and learner wellbeing
  • fulfil the Council's statutory participation, tracking and NEET prevention duties

What information do you keep about me?

The information shared will be limited to what is necessary and may include the following.

  • Name
  • Date of birth
  • Unique Learner Number (ULN)
  • Attendance concerns or risk indicators
  • Free School Meal eligibility indicator
  • Pupil Premium indicator
  • Risk of becoming Not in Education, Employment or Training (NEET) indicator

In some circumstances, information relating to wellbeing, safeguarding, Special Educational Needs and Disabilities (SEND), vulnerability or support needs may also be shared where this is necessary, lawful and proportionate to support the young person.

What gives you the authority to receive and use information about me?

Bury Council processes this information under its statutory duties relating to education participation, tracking and support for young people.

The legal framework supporting this includes:

  • Education and Skills Act 2008
  • Education Act 1996
  • Children Act 2004
  • Children and Families Act 2014

The lawful basis for processing personal data is:

  • Article 6(1)(e) UK GDPR – Public Task

This means the processing is necessary for the performance of tasks carried out in the public interest or in the exercise of official authority vested in Bury Council.

Where special category information is processed, an additional legal condition under Article 9 UK GDPR and the Data Protection Act 2018 will also apply.

What are the consequences if information about me is not provided?

The information shared under these arrangements is generally obtained from education providers and Council records rather than directly from young people.

Without appropriate information sharing, Bury Council and Post-16 Education Providers may be less able to identify concerns early and offer timely support to help learners remain engaged in education or training.

What types of organisations do you share information about me with?

We may share personal information with:

  • Colleges
  • School sixth forms
  • Further education providers
  • Training providers
  • Relevant services within Bury Council
  • Other local authorities where appropriate and lawful
  • Organisations involved in safeguarding and supporting young people where required

Information is only shared where there is a lawful basis to do so and where it is necessary and proportionate.

What do you do when you need to share information about me?

Information is shared securely and only with authorised staff who have a legitimate need to know.

Any information sharing is carried out in accordance with UK data protection legislation and formal Information Sharing Agreements between the organisations involved.

Information shared under these arrangements will only be used for:

  • Supporting attendance and engagement
  • Identifying risk of disengagement
  • Providing support and intervention
  • Safeguarding and wellbeing purposes

Information will not be used for marketing purposes or any unrelated activity.

What types of organisations provide information about me?

As well as information already held by Bury Council, information may be received from:

  • Schools
  • Colleges
  • School sixth forms
  • Training providers
  • Other local authorities
  • Relevant Bury Council services
  • Organisations involved in safeguarding and supporting young people where appropriate

How long do you keep information about me?

Information is retained in accordance with Bury Council's records management and retention schedules.

Where information forms part of a young person's participation, tracking or support record, it will be retained in line with the retention arrangements for the Connexions Service and related statutory education functions.

Personal information will not be kept for longer than is necessary and will be securely deleted or disposed of when it is no longer required.

How do you keep information about me safe?

We have appropriate technical and organisational security measures in place to protect personal information from unauthorised access, loss, misuse, alteration or disclosure.

This includes:

  • Secure electronic systems
  • Access controls based on business need
  • Encrypted and secure methods of transfer
  • Audit and monitoring arrangements
  • Staff training on data protection and information security

How can I access information you hold about me?

You have rights under UK data protection legislation, including the right to:

  • Request access to your personal information
  • Request correction of inaccurate information
  • Request restriction of processing in certain circumstances
  • Object to processing where applicable
  • Lodge a complaint if you are unhappy with how your information is being used

Who can I complain to?

If you are unhappy with the way Bury Council has handled your information, you can contact the Information Governance Team in the first instance.

You also have the right to complain to the Information Commissioner's Office (ICO).
