Who we are

Bury Council is committed to ensuring that we are transparent about the ways in which we use your personal information and that we have the right controls in place to ensure it is used responsibly and is kept safe from inappropriate access, theft, or misuse.

We provide a broad range of services as well undertaking regulatory and administrative activities. These include the provision of education, child protection and care services (supporting early years, vulnerable adults, and the elderly), the collection of taxes, administration of local welfare benefits and grants as well as our regulatory, enforcement and licensing activities.

This notice explains how Bury Council will use your personal information and tells you about your privacy rights and how the law protects you.

Summary of the use of the Database

Our core data protection obligations and commitments are set out in the council’s primary privacy notice.

This notice provides additional privacy information for services provided by, and duties undertaken by, the Waste and Recycling Collection service when you contact us.

We collect your personal information for the delivery of waste and recycling collection services, this includes, assisted collections, additional waste capacity, replacement or new bin deliveries, bulky waste collections, recovery collections in the event that your scheduled collection was missed for any reason, and to contact you if we encounter any issues conducting waste and recycling collections.

We also collect your information for reporting problems to third parties, for example, Greater Manchester Combined Authority (GMCA), Metropolitan Police, Fire Service and Six Town Housing.

It is important that you read this notice, together with any other privacy information we provide on specific occasions when we are collecting or processing personal information about you, so that you are aware of how and why we are using such information.

What information we will collect from you (the purpose and legal basis for processing information)

To carry out these purposes we collect the following types of information.

Householder:

  • Your name
  • Your address
  • Billing address if different to your address
  • Your phone and/or email contact details
  • Your debit card, credit card or bank details, if you are making a payment – this information is only used to complete the payment transaction and is not stored or retained by the Waste department.
  • Type of additional waste generated for the waste audit.
  • Location of bins for an assisted collection
  • Contact we have had with you, such as any correspondence and formal complaints.
  • Access codes and keys for gated communities for the purpose of access to the bin store to empty the bins.
  • Photographs of waste and recycling containers, fly tipping, and excess waste for providing education, evidence, and support.
  • CCTV and video footage from the waste and recycling collection vehicles for the purpose of the public and staff safety and crime prevention and detection

  • Contact we have had with you, such as any correspondence and formal complaints.
  • Access codes and keys for the purpose of access to the bin store to empty the bins.
  • Photographs of waste and recycling containers, fly tipping, and excess waste for providing education, evidence, and support.
  • The Waste and Recycling service have opted to include 360-degree surveillance cameras and equipment on its fleet of Waste and Recycling Collection vehicles. The cameras have been installed on the vehicles to:
    • Create a safer working environment for employees providing waste and recycling collections across the borough.
    • Enable the service to utilise CCTV footage as a component of part of an accident/incident investigation.
    • Enable the service to verify complaints and enquiries in relation to ‘missed’ bins.
    • Improve the quality of evidence provided by the Council in its defence of insurance claims, thereby reducing costs and assisting the Council in defending fictitious claims.
    • Reduce time spent investigating insurance claims.
    • Ensure witness statements are true and are an accurate reflection of events; and
    • Act as a deterrent in cases of potential verbal and physical abuse.

We will collect information under Article 6 of the UK General Data Protection Regulations enabling us to deal effectively with your query.

Marketing purposes: where we have asked, and you have consented to receive electronic marketing information about our services (you may withdraw your consent at any time).

If you fail to provide certain information when requested, we may be unable to address your query, issue or complaint or any further issues which may arise as a result.

How we ensure the security of your data

Your information will be stored electronically on our customer relationship Management database (known as WACA).

We are committed to ensuring your personal information is safe and protected from accidental loss or alteration, inappropriate access, misuse, or theft.

As well as technical, physical, and organisational controls, we recognise that a well-trained, informed and security alert workforce minimises privacy risks from human error and/or threats from malicious actors.

We require our service providers to implement appropriate industry standard security measures and only permit them to process your personal information for specified purposes in accordance with our contractual instructions.

Information Retention

Bury Council will keep your information for as long as necessary to fulfil the purpose we collected it for, and, in alignment with our Record Retention Procedures as detailed below:

  • Replacement or new bin deliveries: 28 days after we have delivered the replacement or new bin to your address or advised you of any reason for non-delivery.
  • Bulky waste collections: 48 hours after we have collected your bulky items.
  • Recovery collections: 48 hours after we have recovered the missed collection.
  • CCTV Footage – 28 days
  • Corporate complaints – 6 years

Transferring data

All data collected as part of this project will remain in UK.

Data sharing

We may be obligated to share your personal data to comply with a legal obligation and statutory function:

  • Information held on Council departments databases
  • Landlords or letting agents
  • Other members of the public when they report a problem
  • Anonymous fraud referrals from members of the public
  • Greater Manchester Combined Authority (GMCA) to provide them with information regarding an enquiry for the Household Waste Recycling Centre, disposal site or communication campaign
  • Metropolitan Police
  • Help business partners, suppliers, and sub-contractors to deliver any contract we enter with them or you
  • Help us if we need additional professional or legal advice on a matter relating to you.

What rights do individuals have?

Bury Council must comply with the UK General Data Protection Regulations (UK GDPR) and the Data Protection Act 2018.

Under data protection law, your rights include:

  • Your right of access - You have the right to ask us for copies of your personal information
  • Your right to rectification - You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete
  • Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances
  • Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances
  • Your right to object to processing - You have the right to object to the processing of your personal data in certain circumstances
  • Your right to data portability - You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances
  • Your right to be informed – You have the right to be informed about the collection and use of your personal data
  • Rights relating to automated decision making and profiling – You have the right to challenge decisions made solely by automated means without any human involvement.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
