I have a tenancy - what are my rights?
Rights of secure tenants
You will be a secure tenant if the following apply.
- You live in the accommodation as your only principal home. If you are a joint tenant then this must apply to one of you.
- Your landlord is the Local Authority or Registered Social Landlord except for Local Authority introductory tenants in the introductory period or Registered Social Landlord.
Statutory rights (your rights in law)
As a secure tenant you have the right to:
- Security of tenure-you can only be evicted if one of the grounds of possession is proved it is reasonable to do so (for some grounds) and the correct notice has been served.
- Succession.
- Assignment.
- To take in lodgers.
- Exchange your home with another secure tenancy.
- Certain repairs to be done by your landlord.
- Undertake your own repairs under a special scheme.
- Improve your home.
- Consultation on matters affecting your tenancy.
- Access to the rules on allocation, transfer and exchanges.
- Access to personal files.
- The right to buy.
- Transfer to another landlord (Local Authority Only).
- A fair rent (Housing Association only).
