Flytipping is the illegal deposit of waste on land. It is an environmental crime which blights our neighbourhoods. Bury MBC is committed to stop fly tipping and to prosecute those who do it in accordance with our Enforcement Policy.
Flytipping, by those who cannot be bothered or who want to save themselves money, costs landowners and Council Tax payers thousands of pounds a year in removal and disposal costs.
From 21 November 2005 all householders in England have a responsibility under the waste 'Duty of Care', to ensure their rubbish is passed on to authorised carriers only. Householders not taking reasonable measures to do so could face fines of up to £5,000.
That's not fair – lets stamp it out!
The flytipping of controlled waste is a serious criminal offence which carries a fine of up to £20,000 (unlimited if indicted to the Crown Court) or an offender can even be sent to prison.
It is important to realise that it is also an offence to allow flytipping to occur on your land.
Protect Yourself
If you are asking someone to dispose of waste on your behalf, ensure that they are a registered waste carrier. You are responsible for checking that they are registered. Always get a receipt confirming what they have taken, where they have disposed of it and details of any payment made.
Don't allow your waste to be flytipped!

If you see someone flytipping don't put up with it – report it!
Fly tippers are doing something illegal, they do not want to be caught – do not approach them. Only approach the site when you are sure it is safe to do so.
If you discover flytipped waste after the tippers have left, please follow these simple do's and don'ts:
- Do not touch the waste - flytipped waste can be dangerous - it may contain syringes, broken glass, asbestos, toxic chemicals or other hazardous substances.
- Do visually inspect the waste - try to determine what the waste consists of and how much there is.
- Do take note of its exact location - and whether it is in or near water.
- Do not disturb the site - there may be evidence that could help identify the culprits and lead to their prosecution.
- Do report any evidence you have - make notes if possible
What is meant by evidence?
The Council may wish to prosecute the offenders and will be keen to use your evidence or information about the incident in court. Even if you do not wish to be a witness or to give your name it is still important that environmental crime is reported so that we can stamp it out. When you contact us to report flytipping please supply as much information as you can:
- Your details, name address, telephone number
- The day, date and time you saw the tipping
- Location of the dumped rubbish
- Did you see anyone in the act of tipping
- How many people were flytipping and what they looked like
- Did you recognise anyone? What are their names and addresses
- Any vehicles involved - their make, colour and registration number
- Time the tipping started and the time it stopped
- Where were you when you saw the tipping?
- What kind of view you had
- How far away you were
- Weather and light conditions
- What was dumped or what did it look like ? Was it, for example, black bags, furniture, rubble, food waste, drums
- How much was tipped? Was it, for example, two black bags, car boot load, tipper lorry load
- Were there any other witnesses? What are their details if they are happy to help
Remember - don't put yourself at risk!
Don't worry if you do not have all these details – still Report it!
The rubbish can be removed and with your help the crime investigated.
