Unitary Development Plan

Welcome to the online version of the Bury Unitary Development Plan (UDP), prepared by the Planning Policy Section.

The Bury UDP acts as a guide for the future development or protection of land in the Borough. To fulfil this role, the UDP contains a wide variety of policies and proposals. Some of these indicate where development, such as housing or industry, is considered acceptable, whilst others seek to control development in order to protect the environment or valuable areas of open space.

Legislation (Section 38 of the Planning and Compulsorty Purchase Act 2004) requires that decisions on planning applications should be made in accordance with the development plan unless material considerations indicate otherwise.

The current Bury UDP was adopted by the Council on 29 August 1997. A review of the Bury UDP was commenced in 2001 but this was abandoned in favour of the Government's new development plan arrangements for Local Development Frameworks (LDF).

The Planning and Compulsory Purchase Act 2004 allowed local authorities to save existing policies until 27 September 2007, unless they apply to extend them beyond this date. The Council made an application to save all the UDP policies except OL7/1 (East Lancashire Paper Mill Water Catchment Area), and the Secretary of State has directed that all the other UDP policies can be saved.

Policy OL7/1 (East Lancashire Paper Mill Water Catchment Area) expired on 27 September 2007.
